Terms of Service

1. Who we are

Elephant in the Room (“Elephant in the Room”, “we”, “us”, or “our”) is a service operated by Elephant in the Room, a French simplified joint-stock company (société par actions simplifiée, SAS) registered under RCS Paris 107 908 337, based at 16 rue de Vézelay, 75008 Paris, France. These Terms form a binding agreement between you (or the organization you represent) and Elephant in the Room.

2. The service

We provide an AI-native platform that maps how an organization operates and deploys automations that run in production. Access to the platform may be offered under a separate order form or subscription agreement, which prevails over these Terms in the event of conflict.

We may update, improve, or modify the platform at any time. We will make reasonable efforts to notify you of material changes that affect your use of the service.

3. AI-generated output

The platform uses artificial intelligence, including third-party language models, to generate analyses, drafts, and recommendations. This output is a suggestion produced by software; it is not certified legal, financial, or professional advice.

You remain solely responsible for reviewing and validating AI-generated output before relying on it, and for its compliance with the regulations that apply to your activity. To the extent permitted by law, Elephant in the Room accepts no liability for a decision made solely on the basis of AI-generated output without prior human validation.

4. Connected accounts

Some features require you to connect third-party accounts, such as Google (Gmail, Calendar, or Drive). By connecting an account, you authorize us to access the data needed to provide the features you have enabled, as described in our Privacy Policy. You can revoke this access at any time.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

5. Acceptable use

You agree to use the platform only for lawful purposes and in accordance with these Terms. You must not attempt to reverse engineer, disrupt, or gain unauthorized access to the platform or its underlying systems.

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any credentials issued to you.

6. Intellectual property

The platform, including all software, models, and documentation, remains the exclusive property of Elephant in the Room and its licensors. Nothing in these Terms transfers ownership of our intellectual property to you.

You retain ownership of the data and content you submit to the platform, subject to the license you grant us to operate the service.

7. Confidentiality

Each party agrees to protect the other party's confidential information with the same degree of care it uses for its own confidential information, and to use it only for the purposes contemplated by these Terms.

8. Liability

To the maximum extent permitted by law, the platform is provided “as is” without warranties of any kind. Our aggregate liability arising out of or related to these Terms is limited to the amounts paid by you in the twelve months preceding the event giving rise to the claim.

9. Governing law

These Terms are governed by French law. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the competent courts of Paris, France.

10. Changes to these Terms

We may revise these Terms from time to time. The updated version will be indicated by the “Last updated” date above and takes effect as soon as it is published.
